Jury Awards $821,000 for "Closed Head Injuries"
Injury A Brewer, Maine couple were recently awarded $821,000 for injuries the 34 year-old wife, Viola Trask, suffered in a three car accident.
Larry Willey was trial co-counsel to Ted Curtis, and stated that "the award was very appropriate and justified."
What makes the case unique is the element of a Closed Head Injury. The impact in this accident caused Ms. Trask to hit her head on the dash board. She was knocked unconscious for a period of 30 seconds to one minute. Trask had immediate onset of neck and back pain. Her cognitive and psychological faculties declined over time, as the result of a Closed Head Injury.
Willey said "...closed head injuries are very difficult to diagnose, so are often overlooked." These injuries, especially those associated with temporary unconsciousness, frequently go unnoticed. Willey emphasized that lawyers need to be aware of the possibility of such injury."
After a five day trial and two hours of deliberation, the jury of four men and four women unanimously found Defendant Gretchell negligent. They awarded Trask $756,000 for her injuries. Her husband was awarded $65,000 for loss of consortium.
Willey said another of the case's challenges was to "present to the jury in an expedited way. I had to pare down the case from the vast number of witnesses who could potential testify."
Last year, Willey tried another negligence case for a Plaintiff with Closed Head Injury and that jury rendered a $120,000 Plaintiff's verdict.
